Hello, everyone. The end of the day on Monday, February 3rd marks entry into the third week for the New Mexico Legislative session. As of the morning of February 3, 2025, the legislative website showed 492 bills that have been introduced.
As far as the Paid Family and Medical Leave Act, HB 11, both the House Health and Human Services and Commerce and Economic Development Committee have recommended the bill with a “Do pass.” This particular piece of legislation, if passed, will affect all employers, both private and public, with at least five employees. Some employers who have their own plans in place may apply for a waiver. In the case of a waiver, the Act will require employers to essentially have an equitable policy with similar provisions to the Act. We continue to keep a look out on this one.
Below are additional bills that have Human Resources items or impact that are on the list of bills:
HB 139 IPRA Changes
HB 146 Railway Safety Act
HB 156 Increase Educational Salaries
HB 164 Increase Retiree COLA
HB 169 Public Expression Protection Act

While not strictly an HR bill, the Inspection of Public Records Act (IPRA), which applies to public entities in the State of New Mexico, has changes to repeal multiple sections of the existing Act and includes 44 pages of new material. Of particular interest is the language about providing information related to settlements.
Southwestern HR Consulting (SWHRC) will continue monitoring HR related bills during this session. Contact SWHRC today at the link above to find out more about our services and our team of experts.
