Federal Contractors and the VEVRAA

Employers who have federal contracts or subcontracts in the amount of $150,000 or more and who have 50 employees must submit an Affirmative Action Plan (AAP) annually and are subject to the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). VEVRAA has nondiscrimination and affirmative action provisions related to the hiring of Veterans and must either compare the percentage of hires that are protected veterans in their AAP against the hiring benchmark set by the Office of Federal Contract Compliance Programs (OFCCP) or may develop an individualized hiring benchmark. The 2022 OFCCP annually designated VEVRAA Hiring Benchmark has been reduced from 5.6% to 5.5%.

Private sector employers with 100 or more employees and federal contractors with 50 or more employees must submit workforce demographics, which include race/ethnicity, gender, and job categories, as required under Title VII of the Civil Rights Act. See the following link for additional criteria on applicability. The deadline to submit and certify their information is May 17, 2022, and it can be filed using the online filing system.
