EEOC’s “Know Your Rights”
Last week, I reported on the Equal Employment Opportunity Commission (EEOC) listening session on its proposed strategic plan. During the listening session, the importance of being clear with the public about the process for filing a claim with the EEOC was discussed.
The EEOC recently sent a notice that they have published a new “Know Your Rights” poster. This poster will replace the old “EEO is the Law Poster” and has a QR code that links directly to instructions on how to file a charge.
The poster is effective October 20, 2022, and it supersedes prior posters. It is available in formats for printing or for screen readers and is available in English and Spanish. (Additional languages will be available at a later date.) Covered employers may access the EEOC site to access the electronic version and/or print out a hard copy.
Most employers are generally considered covered employees by EEOC laws if they have at least fifteen employees. But this number can vary on the type of employer and the type of alleged discrimination. While some private employers are covered, state or local agencies, federal agencies, employment agencies, and unions are also covered. Also, some private employers may not be covered under the EEOC laws but may be covered under local laws. In the state of New
Mexico, for example, employers with four or more employees are covered under the New Mexico Human Rights Act, and additional provisions may be applicable if there are additional employees.
